When can you pull your gun for self defence?

The core principle of self-defense is using reasonable force to protect yourself or others from imminent harm.  Reasonable force is proportional to the threat.  Here’s when a shooting might be considered self-defense:

  • Imminent threat: The attacker poses a danger of death or serious bodily injury right now.
  • No duty to retreat: In some states (Stand-Your-Ground laws), you have no obligation to retreat from danger before using force. In others (Castle Doctrine laws), this applies only in your home.
  • Innocence: You haven’t initiated the confrontation and aren’t committing a crime yourself.

Important Considerations Before Shooting

  • Exhaustion of all other options: Can you de-escalate? Escape? Use non-lethal deterrents (pepper spray, taser)?
  • Proportionality of force: Is a firearm truly necessary to stop the threat?
  • Identification of the target: Are you sure who you’re shooting at? Is there anyone else in the line of fire?

  • Call 911 immediately. Explain the situation calmly and clearly.
  • Do not tamper with the scene. Leave the firearm where it is.
  • Do not speak to anyone about the incident except law enforcement upon arrival.
  • Seek legal counsel as soon as possible.
